Terms and Conditions

The Vacantier website and its services are operated by Vacantier ("Vacantier", "we"). Our identification details are in the "Site operator" box on this page.

By using the site, you accept these terms. When you create an account, you accept them explicitly by ticking the box on the form; we keep the date and the version you accepted. If you do not agree with them, please do not use the site.

These terms are complemented by the Privacy Policy, which explains what data we process and why, and by the Cookie Policy. Agencies are additionally bound by the "Agency portal" section below and by the commercial terms described in the Programme for agencies.

Vacantier is a travel offer comparison service for the Romanian market. We bring hotel prices, holiday packages published by travel agencies and a flight search together in one place, put them in a comparable form, and send you to the website of the partner selling the offer you choose.

Vacantier is not a travel agency, not a tour operator and not an intermediary to your travel contract. In practice:

• we do not sell accommodation, holiday packages or flights;
• we do not collect payments, deposits or guarantees, and we never ask for your card details;
• we do not make bookings on your behalf and keep no record of your bookings;
• we are not a party to the contract you conclude with the agency, the hotel, Agoda or Kiwi.com.

Site

the Vacantier website, in any of its languages, together with its pages, forms and the emails it sends.

Traveller

anyone who uses the site to search, compare or follow offers, with or without an account.

Partner

the provider of an offer shown on the site: a travel agency or tour operator, Agoda (for hotels), Kiwi.com through Travelpayouts (for flights), or an affiliate network through which we receive offers.

Agency

a partner that publishes its offers through the agency portal, by automated feed or by entering them manually.

Offer

a combination of accommodation, dates, board type and, where applicable, transport, at the price asked by the partner, as we received it from them.

Account

the account a traveller or an agency creates, protected by an email address and a password.

Price alert

a traveller's request to be told by email when the price of a followed hotel drops.

Saved search

a set of search criteria kept in the account, for which we may send a digest of new offers.

You can search, filter, compare offers and reach partner websites without an account and without giving us any personal data. An account is only needed for favourites, price alerts and saved searches.

The site is free for travellers. We charge nothing for searching, comparing or being sent to partners, and the price you pay the partner does not go up because you came from us.

To create an account you must be at least 16 and give us a name, an email address that belongs to you and a password. We confirm your address through a link sent by email; until it is confirmed we send you no alerts.

You are responsible for keeping your password safe and for what happens in your account. If you suspect someone else has used it, change your password in your Account settings or reset it from the sign-in page, and let us know.

You can change your name, email address, password and email language and delete your account at any time from your Account settings. Deletion is final and includes your favourites, alerts and saved searches.

With an account you can keep hotels as favourites, set price alerts and save searches. These features exist so that we can watch prices for you:

• a price alert regularly checks the followed hotel's prices and emails you when a new lower price appears, with a pause between messages so you are not emailed repeatedly about the same drop;
• a saved search, if you chose to be notified, can bring you a digest of new offers matching your criteria;
• every email has an unsubscribe link that works in one click, without signing in; alerts and notifications can also be stopped from your account.

Alerts are an information service, not a guarantee. A price we report may no longer be available when you reach the partner's site, and a price drop may go undetected if the partner did not send it to us in time.

Offers, prices, photos and descriptions come from partners. We update them automatically several times a day and show on each offer how recently its price was checked. We work to keep the information accurate, but we cannot guarantee it:

• price and availability can change at the partner between our last check and the moment you reach their site;
• the price that counts is the one the partner shows before payment; if it differs from ours, the partner's price applies;
• we show prices with mandatory taxes included, as the partner sends them; optional services or those paid locally (resort tax, transfers, luggage) may appear separately;
• conversion into another currency is indicative and uses the rate published by the National Bank of Romania; the partner charges in its own currency, at the rate on the day of payment;
• Agoda hotel prices are requested live for the dates and number of guests chosen and may differ for another combination.

If you notice a wrong or misleading offer, write to us at [email protected]. We check it and, where necessary, hide it until the partner corrects it.

Results are ranked by relevance ("Recommended") by default. For holiday packages, relevance is driven by the offer score, which compares its price with the usual price of the same stay over the last 90 days, with comparable hotels in the same resort, and with guest reviews. For hotels, relevance is driven by the number and rating of reviews.

You can change the order at any time: by price, price per night, rating, departure date or star rating.

Ranking does not depend on commissions or any other payment. No agency can buy a better position, a higher score or a good-deal label, and sponsored offers, should they ever exist, will be clearly marked as such.

When you press "View offer" or choose a flight, you go to the partner's website. From there, booking, payment, confirmation, changes, cancellation, refunds and complaints are solely between you and the partner and are governed by their terms:

• for holiday packages, the contract is concluded with the agency or tour operator, which is responsible for performing it, including under the law on package travel;
• for hotels, the booking is made on Agoda, under the terms of Agoda and the hotel;
• for flights, the booking is made on Kiwi.com, under the terms of Kiwi.com and the airlines.

Vacantier may receive an affiliate commission or a fee from some partners for the visitors sent or the bookings made. The price you pay does not change because of it. Before paying, read the partner's terms, especially those on cancellation and travel documents.

Travel agencies can request access to the portal through an agency account. A request does not grant access automatically: an administrator checks the agency and links the account to it. We may decline a request without giving reasons.

An agency using the portal undertakes:

• to be authorised to sell the travel services it publishes, with the licences and guarantees required by law;
• to publish real and complete prices, with mandatory taxes included, and to update or withdraw them when they change;
• to send travellers to a page showing the same offer at the same price;
• not to publish false, misleading or unlawful content, or content it has no rights to (text, photos, trademarks);
• to keep the access details to its account and offer feeds confidential and to tell us if they have been compromised.

The agency grants us a free, non-exclusive licence, for the duration of the collaboration, to display, reformat, translate and compare the offers it sends. We may reject, hide or correct an offer that breaks these rules and may suspend the access of an agency that repeatedly breaks them. The commercial terms are those in the Programme for agencies or in a separate agreement; where they differ, the separate agreement prevails.

By using the site, you agree not to:

• automatically extract content, prices or offers (scraping, crawling, or indexing other than by search engines that respect robots.txt), or reproduce the database or substantial parts of it;
• generate artificial clicks to partners or automated traffic that distorts statistics or commissions;
• circumvent access limits, security measures or authentication, or try to access accounts or data that are not yours;
• use the site to send unsolicited messages or to subscribe email addresses that are not yours to alerts;
• upload or transmit malicious code or unlawful content.

We may limit, suspend or close the access of anyone who breaks these rules and may keep the information needed to defend our rights.

The Vacantier name and logo, the site's design, the texts we write, the scores, the statistics and the way the data is organised belong to us and are protected by law. You may use them only to consult the site for personal, non-commercial purposes.

Offer descriptions, photos and trademarks belong to the partners or their owners and are shown with their consent. Destination photos are credited to their authors.

You are free to share links to our pages.

The site contains links to and components from partners, such as the Kiwi.com flight search. We do not control these sites and services and are not responsible for their content, availability, security or data practices. When you use them, their terms and policies apply.

We work to keep the site available and accurate, but provide it "as is". Interruptions for maintenance, partner errors or technical faults may occur.

To the extent permitted by law, Vacantier is not liable for:

• the performance or non-performance of travel services by partners, including cancellations, overbooking, schedule changes or the quality of the accommodation;
• differences between the information shown and that of the partner, including price and availability;
• indirect losses, such as lost profit or lost opportunity;
• damage caused by third-party sites and services you reach through our links.

Nothing in these terms limits the rights you have by law as a consumer, nor excludes our liability for intentional acts or gross negligence.

You can close your account at any time from your Account settings. We may suspend or close an account that breaks these terms, is used fraudulently or has not been confirmed. We will tell you by email, unless doing so would jeopardise an investigation or the security of the site.

We may change, pause or close any of the site's features. If we close a service linked to your account, we will tell you in advance.

We may update these terms when the service or the law changes. The date they take effect is shown at the top of the page. We notify account holders of significant changes by email at least 15 days in advance. If you do not agree with the new version, you can close your account before it takes effect; continuing to use the site means accepting it.

These terms are governed by Romanian law. We try to settle any complaint amicably: write to us at [email protected] and we will answer within 30 days at most.

If we cannot reach a solution, as a consumer you can turn to the Romanian National Authority for Consumer Protection (ANPC), including its alternative dispute resolution (ADR/SAL) procedure, or to the competent Romanian courts. Complaints about a booking should be addressed to the partner that sold it.
